Presentation
Canon marriage law is an example of the articulation between the truth of substance and the technical resources of juridical science. The administration of justice in the Church finds in matrimonial law its greatest activity. It constitutes the spearhead of its judicial function. More and more dioceses have established tribunals. The judicial structure is growing considerably in the Church as a result of the Apostolic Letter Mitis Iudex Dominus Iesus. The continuous preparation of the intervening agents is core topic for the existence of a just process.
The XXXII Course of update of Canon Law of the University of Navarra focuses mainly on procedural issues, and has as its axis the figure and function of the judge. Pope Francis, taking up the teaching of his predecessors, has recalled that truth is the raison d'être of the process of declaration of marital nullity, through the evidence practiced. Both the evidence presented and its evaluation demand that the truth declared in the sentence be reasonable and communicable, since faith not only does not disavow reason, but dignifies it.
Once the contrast between justice and mercy is overcome, a higher standard of rationality in the process will contribute to the credibility of the faithful in the ecclesial administration of justice.
