"The existence of different educational models is indispensable to guarantee a quality Education "

"The existence of different educational models in a pluralistic society is indispensable to guarantee a quality Education ". This was affirmed at the University of Navarra by Daniel Tirapu, Full Professor of State Ecclesiastical Law. The expert from the University of Jaen participated in the academic workshop organized on the framework of the feast of St. Raymond of Peñafort, patron saint of the School of Canon Law.

In his message he exposed that in Spain they want to bet on a single model educational : "Whoever does not follow it is considered a model of Education segregating ". And he stressed that "a serious school quality pact is necessary".

During the session, he recalled some current issues on the freedom of teaching in Spain. Among them, he emphasized the Constitutional Court Ruling of April 10, 2018, which dismissed the resource of unconstitutionality filed by 50 socialist deputies against a series of articles of the Organic Law of 2019, for the improvement of educational quality LOMCE. And he pointed out that, of the issues addressed by this ruling, "the ones with the most media repercussions have been: the treatment of the centers of Education differentiated and the teaching of religion as subject in Education Primary and Secondary".

He assured that "the great ideological battles and social submission are in the control of the Education" and highlighted the importance of the Right to the Education contained in the Charter of Fundamental Rights of the European Union (2007), whose main points are three: agreement the first, everyone has the right to Education and access to professional and permanent training ; the second, this right includes the School to receive free of charge the compulsory teaching ; and the third, the freedom to establish educational establishments in compliance with democratic principles, as well as the right of parents to ensure the Education and the teaching of their children according to their religious, philosophical and pedagogical convictions are respected, in accordance with the national laws regulating its exercise, and the third, the right of parents to ensure the and the of their children according to their religious, philosophical and pedagogical convictions.

The choice of model educational : a parental right

For Tirapu, the Right to Education of the Charter of Fundamental Rights of the European Union "has a balance of three elements: the family, the state, and the social initiative and religious denominations". He also declared that the novelty lies in the third point: "Because it underlines that the right belongs to all individuals, but the choice of model educational is up to the parents. The School to choose the Education according to their pedagogical convictions expands the freedom of parents in their right of choice and, in my opinion, it represents a clear limit for the States to opt for a single pedagogical model . In addition, it opens up new and creative possibilities to the traditional school model , such as instruction in family groups, through the Internet or at a distance".
